3. Dedicated Nodes
3.1 Scope of Services
3.1.1 GigaLinked provides Game Server Hosting, Dedicated Nodes, Web-Hosting Services, and other related solutions. Additional functionalities (like control panels, server management tools, etc.) may be included or offered as add-ons.
3.2 Performance and Limitations
3.2.1 We strive to maintain a high uptime. However, no service can be guaranteed 100% uninterrupted, especially in the event of maintenance, hardware failures, DDoS attacks, or force majeure circumstances.
3.3 Proprietary Rights
3.3.1 Unless explicitly stated, all materials, content, logos, and software used within our Services remain the property of GigaLinked or its licensors.
3.3.2 Users may not reverse-engineer, decompile, reproduce, or distribute any protected materials without express permission.
3.4 Dedicated Node Solutions
3.4.1 A Dedicated Node is a self-managed, contained VPS provided exclusively for the User's use. It comes pre-configured with Pterodactyl, a game server management panel, designed to deliver an intuitive and user-friendly experience for managing game servers, websites, and other supported applications. Each Dedicated Node includes a custom Pterodactyl theme and a selection of open-source add-ons to further enhance functionality and usability.
3.4.2 Users may provide their own domain during the order process. GigaLinked will assist with linking the domain to the node and provide a free SSL certificate to ensure secure access. If a domain is not provided, GigaLinked will issue a complimentary subdomain under "GLNodes.com," structured as NODE-SIZE-ID.GLNodes.com , where NODE-SIZE-ID represents the client’s node specifications and unique identification.
3.4.3 Dedicated Nodes include one public IPv4 address as part of the service. The IPv4 address is billed at a fixed rate, as detailed in the order form, and is not eligible for discounts or adjustments. Users may also request additional IPv4 addresses, which will incur supplementary charges and a setup fee.
3.4.4 Separately charged additional IPv4 addresses and setup fees are excluded from voluntary cancellation store credit. This does not exclude a refund due for a qualifying deployment delay or infrastructure failure under section 6, or any statutory refund right.
3.4.5 Dedicated Nodes are designed with a self-managed protocol that ensures clients have access to all necessary tools and features for creating and managing web servers, game servers, and other supported applications through the provided web interface panel. This design eliminates the need for SSH access, as the Pterodactyl interface includes all functionality required for effective server management.
● 3.4.5a While SSH access is not provided, clients can use FTP and SFTP protocols for secure file transfer and management of their individual servers running on the node.
This ensures full file transfer capabilities without compromising the security or structure of the node.
● 3.4.5b Providing SSH access does not enhance the functionality of the Dedicated Node's web-based panel but introduces potential security vulnerabilities and risks to the structural integrity of the node.
● 3.4.5c By adhering to the self-managed protocol , GigaLinked ensures a streamlined, secure, and user-friendly experience for all clients.
3.4.6 In certain situations, SSH access may be granted upon request. However, this requires the client or their designated administrator to complete a competency evaluation to demonstrate their knowledge of Linux environments and server management. Once SSH access is granted, GigaLinked will no longer provide technical support for software configurations or custom setups beyond network or hardware-related issues. 3.4.7 GigaLinked provides support for Dedicated Nodes in the areas of software issues, network problems, and hardware-related concerns. Additionally, GigaLinked offers guidance and tutorials on using the features and functions of the Pterodactyl web interface upon request. Please note that support does not extend to managing or troubleshooting individual game servers hosted within the panel, as these responsibilities are considered developer-level tasks.
4. Acceptable Use Policy (AUP)
4.1 Prohibited Use
4.1.1 You agree not to host or facilitate:
● Illegal content (pirated software, child sexual abuse imagery, etc.)
● Malicious software or hacking tools ● Content violating intellectual property rights without authorization
● Hate speech, harassment, or other offensive material
● Any content or activity that violates applicable law or third-party rights
4.2 Malicious Activity 4.2.1 Examples : DDoS attacks, spamming, phishing, or excessive resource usage that negatively affects other users. 4.2.2 If a client uses our servers to run a DDoS (even on themselves), we will immediately terminate the service & user, with any refund entitlement determined under section 6 and applicable statutory rights.
4.3 Consequences of Violations
4.3.1 Violations may result in immediate service suspension or termination without prior notice.
4.3.2 GigaLinked reserves the right to report any suspicious or illegal activities to law enforcement.
4.4 Resource Limits
4.4.1 Users must operate within allocated resource limits (CPU, memory, bandwidth). Excessive resource usage may lead to mandatory plan upgrades or service suspension.
5. Pricing, Orders, and Billing
5.1 Pricing
5.1.1 All prices are displayed on our website or client portal and may be listed with VAT.
5.1.2 Prices are subject to change. Usually, prices are adjusted to seasonal changes.
5.2 Order Submission
5.2.1 Placing an order constitutes an offer to purchase the selected service(s). GigaLinked may accept or refuse orders at its discretion.
5.2.2 Upon submitting an order, there can occur occasions to pay any associated fees, including applicable taxes depending on the country/region the consumer is buying from.
5.3 Payment Methods
5.3.1 We accept payment methods, such as credit cards, PayPal, Klarna or bank transfer.
5.3.2 Some payment methods might incur additional fees or require specific conditions (e.g., verifying identity to prevent fraud).
5.4 Payment Failure
5.4.1 If a payment is refused or fails, GigaLinked is under no obligation to provision or continue providing any services.
5.4.2 Any additional fees from failed or refused payments are the responsibility of the User.
5.5 Automatic card payments and renewals
5.5.1 Dedicated-node services renew monthly, quarterly or annually according to the selected billing cycle. Renewal invoices show the recurring amount and are issued seven days before their due date.
5.5.2 Automatic card payments are optional. By selecting the consent checkbox and completing secure Stripe setup, you authorise GigaLinked to charge future dedicated-node renewal invoices on their due date at the amount shown on each invoice. No payment is taken during card setup.
5.5.3 Stripe securely stores and processes your card. GigaLinked does not store your full card number or security code. We retain the Stripe payment references and limited card information, such as the card brand, last four digits and expiry date, to manage your chosen payment method.
5.5.4 You can turn automatic payments off in your client area at any time. A payment already processing may still complete. Turning automatic payments off does not cancel your services; future invoices must be paid manually. Changing your card pauses automatic payments until the replacement setup is completed.
5.5.5 Existing overdue invoices and the first payment after a free trial must be paid manually. If an automatic payment fails or requires additional verification, use Pay now on the invoice to complete payment. The usual due dates and unpaid-service suspension rules still apply.
6. Cancellation and Refund Policy
This policy distinguishes cancellation by choice from refunds for deployment delays or service failures. It does not limit your statutory rights. If another clause appears to exclude a refund that is due under this section or applicable law, this section and the law take precedence.
6.1 Cancelling by choice
6.1.1 You may request cancellation through your client area, either immediately or at the end of your current paid billing period. If the cancellation option is unavailable, contact Billing through a support ticket or [email protected].
6.1.2 End-of-period cancellation: your service continues until the end of its current paid billing period and will not renew. No unused-time credit is due because the paid period remains available to you. Existing suspension rules still apply, and cancellation does not remove charges already owed.
6.1.3 Immediate cancellation: your service is scheduled to stop and its data to be deleted. The unused portion of your eligible prepaid recurring node charges is returned as GigaLinked store credit for future purchases. This is account credit, not a refund to your card, bank account or other payment method. Back up any data you need before confirming cancellation; credit does not preserve or restore a cancelled node or its files.
6.1.4 Store credit is calculated from the amount actually paid for the eligible service after discounts and the unused time remaining in its recorded billing period when cancellation is accepted. Monthly, quarterly and annual billing periods are prorated in the same way. The calculation uses the remaining fraction of the period, including partial days, and rounds down to the nearest penny for each eligible paid invoice. The amount is shown before you confirm.
6.1.5 Eligible charges exclude setup fees and separately charged additional IPv4 addresses or related network charges. Free trials and unpaid time have no paid value to credit. These exclusions apply to the voluntary store-credit calculation, not to refunds required under sections 6.2 or 6.4.
6.1.6 Outside applicable statutory rights or an existing refund commitment, a change of mind or decision to stop using an otherwise functioning service does not qualify for a refund to the original payment method. The voluntary cancellation options above apply instead.
6.2 Deployment delays and infrastructure failures
6.2.1 You may request a refund to your original payment method if a physical deployment or provisioning problem prevents us from supplying your service within the agreed time, or within a reasonable time where no time was agreed. This includes delays caused by unavailable or faulty hardware or our deployment systems.
6.2.2 You may also request a refund where a material failure in the infrastructure used to provide your service, including host hardware, storage or network connectivity, prevents the service from being supplied as agreed. Billing and technical staff will review the cause, duration and impact, and whether the service can be restored within a reasonable time without significant inconvenience. A qualifying failure is not treated as a voluntary cancellation simply because you ask to cancel as a result.
6.2.3 Where the delay or failure qualifies for a refund, we will refund the affected service charges to the original payment method. The amount reflects the service not supplied or the period and extent of the failure. A full refund applies where the affected paid service was never supplied, or where required by law; otherwise we will explain the proportionate amount and calculation. We will not require you to accept store credit instead of a refund you are entitled to receive.
6.2.4 A problem caused solely by your own scripts, plugins, configuration or local internet connection does not by itself establish a failure in our service. We will investigate the available evidence rather than assume its cause. This does not exclude responsibility where our service also failed, or limit any statutory remedy.
6.3 Requesting and processing a refund
6.3.1 Open a Billing ticket in your client area or email [email protected]. Include your service or invoice number, a description of the problem and relevant dates or outage times. Logs or screenshots help if available, but are not a condition for exercising statutory rights. Report ongoing faults promptly so we can investigate and try to restore service.
6.3.2 Original-payment refunds are reviewed and processed by Billing; the immediate-cancellation button provides store credit and does not automatically issue a card or bank refund. Contact Billing if you are cancelling because of a deployment delay or infrastructure failure. Using the cancellation button does not waive any refund entitlement, and any credit already awarded for the same charges will be reconciled to avoid duplicate repayment.
6.3.3 Refund timing for qualifying failures and legal entitlements. This clause does not create a right to a cash refund for ordinary voluntary cancellation: immediate voluntary cancellation is settled in store credit under section 6.1, subject to statutory rights and earlier refund commitments. Where a refund to the original payment method is due under section 6.2 or applicable law, we will explain the decision and calculation and issue it without undue delay. An agreed service-failure refund will be issued no later than 14 days after we agree it is due. If the law requires an earlier deadline or a deadline measured from your cancellation notice, that deadline applies. We do not charge a refund administration fee. Your payment provider may take additional time to display the refund after it has been issued.
6.3.4 Refunds use the original payment method unless you expressly agree to another method. If an invoice was paid partly with store credit, the credit-funded portion is normally restored as store credit and the externally paid portion returned through its original payment method, subject to any different refund rights required by law. No amount will be refunded twice.
6.3.5 We encourage you to contact Billing so we can resolve a payment problem. Opening a payment dispute does not remove your statutory rights or automatically void a valid refund claim. We may coordinate with the payment provider to prevent duplicate repayment.
6.4 Statutory consumer rights
6.4.1 Nothing in these Terms restricts rights that cannot lawfully be excluded. UK consumers buying services online generally have 14 days from entering the contract to cancel without giving a reason. Other rights may apply under the law where you live. These rights are separate from our voluntary store-credit policy.
6.4.2 Starting an ongoing hosting service does not, by itself, remove a consumer’s cooling-off right. If you expressly requested that service start during the cancellation period and the required information was provided, we may charge only a lawful proportionate amount for service supplied before you notified us of cancellation. The right is lost following full performance only where the legal requirements for express consent and acknowledgement have been met.
6.4.3 To exercise a statutory cancellation right, tell us clearly through a Billing ticket or [email protected] that you wish to cancel; no special form is required. For a valid cooling-off cancellation, we will refund the amount due within 14 days of being informed, using the original payment method unless you expressly agree otherwise. You also retain applicable remedies for services not supplied with reasonable care and skill, as described or within the required time, including repeat performance or an appropriate price reduction or refund.
6.5 Existing customers and previous commitments
This policy was updated on 31 October 2026. It applies to new orders from that date. It does not retrospectively remove refund commitments made for earlier purchases, including any applicable 48-hour courtesy-refund eligibility under the terms supplied at purchase. Material changes to existing contracts remain subject to section 1.5 and applicable law. Statutory rights apply regardless of the purchase date.
7. Delivery and Performance of Services
7.1 Service Activation. Deployment normally starts automatically after successful payment. Activation can take up to 48 hours where provisioning or manual review is needed; any different agreed delivery time will be communicated to you. If a deployment problem prevents delivery within the agreed time, or a reasonable time where none was agreed, contact Billing under section 6.2. A deployment delay is not automatically treated as time you voluntarily chose not to use.
7.2 Service Duration
7.2.1 Services remain active for the duration specified (monthly, quarterly, annually, etc.). You must keep payments current to avoid suspension or cancellation.
7.3 Trials Periods
7.3.1 Trial Periods: If a free or discounted service is offered, the user must actively opt to continue or cancel at the end of that billing cycle.
8. Data and Backups
8.1 User Responsibility
8.1.1 You are solely responsible for maintaining off-site backups of data stored on our servers.
8.1.2 We make reasonable efforts to protect data but do not guarantee prevention of data loss due to hacking, hardware failure, or user error.
8.2 Backup Services
8.2.1 Optional backup capacity can be purchased. Such backups are provided “as is,” and we disclaim any liability if backups are incomplete or fail.
8.2.2 Exceeding your storage allocation for backups may lead to additional charges or suspended backup services. 9.3 GDPR and Data Protection
8.3.1 We comply with the UK Data Protection Act 2018 and UK GDPR where applicable.
8.3.2 If you process personal data of third parties on our servers, you must ensure full compliance with applicable data protection laws. Failure to do so may lead to immediate suspension or termination of the relevant services, and you may be held liable for any damages or legal claims arising from your non-compliance.
9. Violations and Termination
9.1 Grounds for Termination
9.1.1 Non-payment of due invoices.
9.1.2 Engaging in malicious or illegal activities, including attempts to DDoS, spam, or compromise systems (even if “testing” on your own server).
9.1.3 Violating any clause in these Terms or the AUP.
9.2 Termination Consequences 9.2.1 No Refund : If we terminate your service due to your violation or misconduct, any refund entitlement remains subject to section 6 and applicable statutory rights. 9.2.2 Data Deletion : All data on our servers may be deleted immediately upon termination, with no obligation for data retrieval.
9.3 Additional Legal Remedies
9.3.1 If your activities cause harm or pose a demonstrable risk to GigaLinked, its users, or its infrastructure (for example, via malicious attacks, legal liabilities, or reputational damage), we reserve the right to seek damages, file legal claims, and involve law enforcement.
9.3.2 In addition, you may be held financially responsible for direct, indirect, or consequential damages arising from your actions, including but not limited to the costs of investigation, remediation, and any third-party claims resulting from your conduct.
10. Intellectual Property and User-Uploaded Content
10.1 Content on Our Application
10.1.1 Unless otherwise stated, all text, images, graphics, software, trademarks, or logos belong to GigaLinked or its licensors.
10.1.2 Users may view or download content only for personal, non-commercial use. Any unauthorized reproduction is strictly prohibited.
10.2 User-Provided Content
10.2.1 Users uploading or creating content on our servers represent and warrant that they are legally allowed to do so, without infringing third-party rights.
10.2.2 By uploading content, you grant GigaLinked a non-exclusive, royalty-free license to process, store, and display such content as required for service operation.
10.3 Content Removal
10.3.1 We reserve the right to remove content deemed illegal, harmful, or otherwise violating these Terms or third-party rights.
10.3.2 Users remain fully liable for any legal claims arising from the content they upload.
11. Liability and Indemnification
11.1 Disclaimer of Warranties
11.1.1 Our Services are provided on an “as is” and “as available” basis. We do not guarantee the Services will be error-free, secure, or meet your specific needs.
11.1.2 Any advice or information obtained from GigaLinked, whether oral or written, does not create any warranty not expressly stated in these Terms.
11.2 Limitation of Liability
11.2.1 To the fullest extent permitted by law, GigaLinked is not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits or data.
11.2.2 Our total liability under any claim shall not exceed the amount paid by you to us in the preceding 12 months for the affected Service.
11.3 Indemnification
11.3.1 You agree to indemnify and hold GigaLinked harmless from any claims, damages, liabilities, or legal fees resulting from:
● Your breach of these Terms or policies
● Violation of any law or third-party rights
● Content uploaded or shared by you
● Misuse of our Services by you or anyone using your account
12. Service Interruptions and Force Majeure
12.1 Planned Maintenance
12.1.1 We may schedule downtime for system updates or maintenance, generally notifying users at least 24 hours in advance when feasible.
12.1.2 During such planned intervals, Services may be partially or fully unavailable.
12.2 Unforeseen Interruptions. Events outside our reasonable control, such as natural disasters or industrial action, may interrupt service. We will take reasonable steps to restore service and explain the impact. Any exclusion of liability for resulting losses is subject to applicable law and does not remove refund rights for qualifying deployment delays or infrastructure failures under section 6.
12.3 Right to Suspend/Terminate
12.3.1 We can suspend or shut down Services if necessary to protect system security or to comply with legal orders, without liability for any associated data loss.
13. Governing Law, Jurisdiction, and Dispute Resolution
13.1 Governing Law
13.1.1 These Terms are governed by the laws of England and Wales. Consumers in other jurisdictions (including EU member states) may have additional statutory rights under their local laws, but the primary governing law remains that of England and Wales.
13.2 Jurisdiction
13.2.1 The courts of England and Wales have exclusive jurisdiction to settle any dispute arising out of or in connection with these Terms.
13.3 Amicable Resolution
13.3.1 Before initiating any legal action, users are encouraged to contact us at [email protected] to seek an informal resolution. We will make every effort to address concerns promptly and in good faith.
14. Miscellaneous Provisions
14.1 Assignment
14.1.1 We may assign or transfer our rights or obligations under these Terms to a third party in connection with a merger, acquisition, or sale of assets. You may not assign or transfer your obligations without written consent.
14.2 No Waiver
14.2.1 Failure by GigaLinked to exercise any right or provision does not constitute a waiver. Any waiver must be explicitly stated in writing.
14.3 Severability
14.3.1 If any section of these Terms is deemed invalid or unenforceable by a court, the remaining sections remain in full effect.
14.4 Entire Agreement
14.4.1 These Terms, along with all referenced policies and documents, constitute the entire agreement between you and GigaLinked, superseding any prior agreements.
14.5 Survival

14.6 Contacts and Notices
14.6.1 Official notices to GigaLinked must be sent to [email protected].
15. Additional Considerations
15.1 DDoS or Malicious Activities 15.1.1 If a user initiates a DDoS attack, even on their own service for “testing,” GigaLinked will: ● Immediately suspend or terminate the service. ● Apply the refund rules in section 6, subject to applicable statutory rights. ● Potentially report the activity to authorities.
15.2 Support Policy
15.2.1 Basic support is included with hosting services, but advanced support (e.g., custom server configurations) may require additional fees.
15.2.2 Support requests should be submitted via our client area . Real-time support via chat or phone is not guaranteed unless stated otherwise.
15.3 High-Risk Use
15.3.1 Our Services are not designed for high-risk activities (e.g., life support, critical infrastructure). Any usage in such environments is at your own risk, and we disclaim liability for damages arising from such use.
16. Final Acceptance
By creating an account, placing an order, or continuing to use any GigaLinked Service, you (the “User”) confirm that you have read, understood, and agreed to be bound by these Terms in their entirety. If you do not agree, you must cease using our Services immediately.
